The effort of outlining a formal membership and organizational structure was discussed in August 2004 at the first KhushDC Board retreat, hosted by DC-MAPS. These guidelines would pave the way for KhushDC Board Elections and make it possible for KhushDC to remain a democratically-run organization. The By-Laws Committee (composed of Prashant, Atul, Kashish, Mark, Theron, Dip, and Ayush) was charged with the responsibility of creating a By-Laws draft to be presented to KhushDC for ratification.

With the exception of Article IV, Section 3 concerning Board Eligibility, the KhushDC By-Laws were ratified by simple majority at the KhushDC By-Laws Ratification Meeting on April 17, 2005. It was decided that the task of resolving Board Eligibility criteria would fall on the first elected KhushDC Board, and a By-Laws Discussion Group was held on May 14, 2005.

The "Policies and Procedures" Committee (composed of Ayush, Ashish, Sivagami, and Ameet) had been charged with the responsibility of creating "Policies and Procedures" documents. On the same day as the By-Laws ratification, the "Policies and Procedures" took effect. These documents take their authority from the By-Laws, specifically Article I, Section 5, and Article III, Section 7.

Under the authority of the By-Laws, the first elected KhushDC Board took up their responsibilities on July 31, 2005. On November 16, KhushDC President Paresh solicited membership feedback to be received by November 30. Paresh did not receive any feedback, therefore it was decided at the January 2006 Board Meeting that a By-Laws Discussion and Vote should be held on March 18, 2006. The announcement was made in the January 2006 Board Meeting minutes and shortly thereafter, the date was published on the KhushDC.org website.

Article IV, Section 3 concerning Board Eligibility was ratified "as-is" by unanimous vote at the By-Laws Discussion and Vote on March 18, 2006. The section being discussed was accepted as "The majority of KhushDC officers (including President and Vice-President) shall be sexual or gender minority General Members who self-identify as South Asian."

It was recognized at the March 18 meeting that the phrasing of Article IV, Section 3 is not internally consistent with the rest of the By-Laws. However, because of the low Discussion Group turnout, it was suggested by moderator Joseph of DC-MAPS to be corrected by amendment at the KhushDC General Membership meeting held in conjunction with the KhushDC Board Elections in July 2006. This would give the KhushDC Membership a chance to comment on the suggested phrasing. For more information, please contact the KhushDC Board.

All KhushDC Members are expected to follow the "Policies and Procedures." Additionally, all persons attending a KhushDC Event (including non-members) are expected to follow the "Membership Policies and Procedures," and all persons on a KhushDC-related Listserv (including non-members) are expected to follow the "Listserv Policies and Procedures."
